APITA UNY e-Shop services has been especially designed by Unicorn Stores (HK) Ltd. for Customers using its online shopping services subject to terms and conditions set out herein (the "Terms and Conditions").


If you intend to use APITA UNY e-Shop services or simply want to browse in APITA UNY e-Shop website (the "Site") or otherwise use the Site, please read the Terms and Conditions carefully before using the Site as the Terms and Conditions govern your use of the Site and your relationship with Unicorn Stores (HK) Ltd. and they affect your rights and liabilities under the applicable laws.


If you do not agree to the Terms and Conditions, please do not register for or use the Site.


By using this Site or any part of it, you are deemed to agree that you have read and understood the Terms and Conditions and that you accept and agree to be bound by them.

  • 1.   DEFINITIONS AND INTERPRETATION
    • 1.1   In this Site, in addition to those defined above, unless otherwise expressed or required by context, the following words and expressions have the meanings set out below:
      • 1.1.1   "Customer" shall mean all persons who register APITA UNY e-Shop services for the purpose of purchase of the Products and/or use of the Site.
      • 1.1.2   "Delivery Information" shall mean the information to be given by the Customer upon making of a purchase order of the Products through this Site.
      • 1.1.3   "Intellectual Property" shall mean all intellectual property rights of whatsoever nature, including (without limitation) any patent, know-how, design, trademark, trade name, service mark, trade secret, confidential information, database or copyright or other similar industrial or commercial right, whether or not registered or registrable by any means, and the right to file an application for registration thereof.
      • 1.1.4   "Hong Kong" shall mean the Hong Kong Special Administrative Region.
      • 1.1.5    "Legal Notice and Disclaimer" shall mean the legal notice and disclaimer applicable to APITA UNY e-shop services.
      • 1.1.6   "Login ID" shall mean the Customer's personal identification used to gain access to the Site under that Customer's registration
      • 1.1.7   "Password" means the Customer's personal password to gain access to the Site.
      • 1.1.8    "Personal Data and Privacy Statement" shall mean Unicorn Stores (HK) Ltd.'s policy regarding personal data collected in connection with APITA UNY e-Shop services and Unicorn Stores (HK) Ltd.'s policy regarding the privacy of the Customers and visitors to the Site.
      • 1.1.9   "Price" shall mean the price of the Product payable to Unicorn Stores (HK) Ltd. by the Customer in accordance with Clauses 7 and 9.
      • 1.1.10   "Product/Products" shall mean any and all the products posted for the purpose of sale on the Site.
      • 1.1.11   "Unicorn Stores (HK) Ltd." shall mean Unicorn Stores (HK) Ltd., the seller of the Products on APITA UNY e-Shop.
      • 1.1.12   "APITA UNY e-Shop" shall mean this internet website owned and operated by Unicorn Stores (HK) Ltd. and the medium whereby Unicorn Stores (HK) Ltd. invites the Customer's offer to purchase the Products from Unicorn Stores (HK) Ltd..
    • 1.2   In this Site:
      • 1.2.1   the Terms and Conditions shall prevail over any other document including any Unicorn Stores (HK) Ltd. store policy purporting to have a contractual effect; and
      • 1.2.2   words and expression in the singular include the plural and vice versa and expressions in any gender shall include other gender.
  • 2.   REGISTRATION
    • 2.1   To register on APITA UNY e-Shop services, the Customer must be over eighteen (18) years of age
    • 2.2   The Customer must ensure that the details provided by him on registration or at anytime are correct, complete and updated.
    • 2.3   The Customer must inform Unicorn Stores (HK) Ltd. immediately of any changes to the information that he provided upon registration on APITA UNY e-Shop services by updating the personal details (including but not limited to the credit card particulars for payment of the price of the Products) to enable Unicorn Stores (HK) Ltd. to have smooth and effective communication with the Customer.
    • 2.4   The Customer can cancel his registration at anytime by informing Unicorn Stores (HK) Ltd. in writing at contact@apitauny.com.hk. If the Customer cancels his registration with APITA UNY e-Shop services, the Customer must stop using APITA UNY e-Shop services.
    •   
    • 2.5   Unicorn Stores (HK) Ltd. has the absolute discretion to refuse registration of a potential Customer and to suspend or terminate the registration of any Customer for any reason whatsoever.
    • 2.6   The suspension or cancellation of the Customer's registration and the Customer's right to use the Site shall not affect either party's statutory rights of liabilities.
  • 3.   PASSWORD AND SECURITY
    • 3.1   When the Customer registers to use the Site, the Customer will be asked to create a Password. In order to prevent fraud, the Customer must keep the Password confidential and must not disclose it or share it with anyone. If the Customer knows or suspects that someone else knows the Password, the Customer should notify Unicorn Stores (HK) Ltd. by contacting contact@apitauny.com.hk immediately.
    • 3.2   Unicorn Stores (HK) Ltd. shall not be responsible for any offline management of the Password and shall not be liable for any loss or damages whatsoever if any third party gains unauthorized access to the Site by using the Customer's Login ID.
    • 3.3   If Unicorn Stores (HK) Ltd. has reason to believe that there is likely to be a breach of security or misuse of the Site, Unicorn Stores (HK) Ltd. may require the Customer to change the Password or Unicorn Stores (HK) Ltd. may suspend the Customer’s account.
  • 4.   USE OF THE SITE
    • 4.1   The Customer may not use the Site for any of the following purposes:
      • 4.1.1   disseminating any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionably material or otherwise breaching any laws;
      • 4.1.2   transmitting material that encourage conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;
      • 4.1.3   interfering with any other person's use or enjoyment of the Site or
      • 4.1.4   making, transmitting or storing electronic copies of materials protected by copyright and/or any Intellectual Property rights without the permission of the owner.
    • 4.2   By using this Site and/or submitting a purchase order of the Products to Unicorn Stores (HK) Ltd. through the Site, the Customer confirms, agrees and acknowledges that:
      • 4.2.1   all the transactions of sale and purchase of the Products between Unicorn Stores (HK) Ltd. and the Customer through the Site are subject to the Terms and Conditions;
      • 4.2.2   the Customer has read, understood and agreed to the Terms and Conditions prevalent at the time a purchase order of the Product is submitted to Unicorn Stores (HK) Ltd.;
      • 4.2.3   The Customer will ensure payment for every purchase order made under the Customer's Login ID and indemnify Unicorn Stores (HK) Ltd. for all claims, loss and damages whatsoever made by any third party arising from the actions of a person placing purchase orders for the Products by using the Customer's Login ID; and
      • 4.2.4   The Customer will be responsible for any loss, cost, claim, liability and expense incurred by Unicorn Stores (HK) Ltd. or its officer employees or agent or affiliates resulting from the Customer's breach of any of his obligations under the Terms and Conditions.
    • 4.3   APITA UNY e-Shop services is available for non-commercial and domestic use only. Unicorn Stores (HK) Ltd. reserves the right to refuse orders from business or that we consider are for commercial or other non-domestic concerns. Unicorn Stores (HK) Ltd., at its sole discretion, reserves the right to limit its sales to anyone including the right to deny sales to re-sellers.
  • 5.   AVAILABILITY OF THE SITE
    • 5.1   Although Unicorn Stores (HK) Ltd. aims to offer all the Customers the best service possible, Unicorn Stores (HK) Ltd. makes no promise that the service at the Site will meet all the Customers' requirements. Unicorn Stores (HK) Ltd. cannot guarantee that the services will be fault-free. If a fault occurs with the Site, the Customer should report it to contact@apitauny.com.hk immediately and we will attempt to correct the fault as soon as we reasonably can.
    • 5.2   The access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the services as soon we reasonably can.
  • 6.   Unicorn Stores (HK) Ltd.'S LIABILITY
    • 6.1   While Unicorn Stores (HK) Ltd. tries to ensure that material included on the Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that material. If we are informed of any inaccuracies in the material on the Site, we will attempt to correct the inaccuracies as soon as we reasonably can.
    • 6.2   Please read Legal Notice and Disclaimer for further details.
  • 7.   PRICE
    • 7.1   Unicorn Stores (HK) Ltd. shall make every effort to ensure that prices of the Products on the Site are update but Unicorn Stores (HK) Ltd. reserves the right to vary price of the Products without any notice.
    • 7.2   The prices advertised on the Site are applicable to on-line shopping through APITA UNY e-Shop services only. Prices for some of the Products may differ from those prices of same products at Unicorn Stores (HK) Ltd. shops. The price of Products is stated for the Customer's guidance only.
    • 7.3   If, by mistake, we have under-priced the Product, we will not be liable to supply that Product to you at the stated price provided that we notify you before we dispatch the Product concerned to the Customer.
    • 7.4   There may be discrepancies between the on-line bill and the final bill due to out-of-stock products, substitutions, special offers, daily price changes and weighed items. Unicorn Stores (HK) Ltd. reserves the right to adjust the on-line bill and such adjustments shall be marked on the final bill presented to the Customer at the time of delivery.
    • 7.5   If the Customer requests a variation to the purchase order which Unicorn Stores (HK) Ltd. accepts then the Price payable for the relevant purchase order will be adjusted accordingly to reflect the variation and shall be recorded on the final bill presented to the Customer at the time of delivery.
    • 7.6   Unicorn Stores (HK) Ltd. may from time to time set credit limits for individual Customers.
  • 8.   PRODUCTS
    • 8.1   Unicorn Stores (HK) Ltd. shall make every effort to ensure that details and sizes of the Products on the Site are update but Unicorn Stores (HK) Ltd. reserves the right to vary the details of the Products without any notice.
    • 8.2   As the actual size of the Product may not exactly correspond to the description specified on the Site, Unicorn Stores (HK) Ltd. reserves the right to provide the Customer the Product, the size of which is the nearest at the nearest price.
    • 8.3   Unicorn Stores (HK) Ltd. shall make every effort to fulfill a purchase order placed by the Customer through the Site, but shall not be liable to any person if Unicorn Stores (HK) Ltd. shall decline or become unable to fulfill a purchase order for whatever reason, including unavailability, shortage of supply or modification of the Products.
    • 8.4   Notwithstanding the provisions of Clause 8.3, Unicorn Stores (HK) Ltd. reserves the right to decline any order it may, in its sole opinion, consider unreliable for credit reason or limitation of sales to non-consumers.
  • 9.   PAYMENT
    • 9.1   The price of the Products ordered through the Site is payable by the Customer to Unicorn Stores (HK) Ltd. by credit cards or cash on delivery.
    • 9.2   Unicorn Stores (HK) Ltd. may change at any time the payment method for the price of the Products ordered through the Site and such changes may be notified to the Customer by e-mail, mail shots or a notice placed on the Site.
    • 9.3   For registration for credit card payment, the Customer shall provide Unicorn Stores (HK) Ltd. with an accurate, complete and update credit card information and represents and warrants to Unicorn Stores (HK) Ltd. that his use of the credit card (details of which have been supplied) is authorized and legal.
    • 9.4   The Customer shall be responsible for updating his registration information including the credit card particulars with Unicorn Stores (HK) Ltd. .The Customer shall be responsible for notifying the relevant bank of any changes to his personal particulars, or loss, theft or unauthorized use of the credit card.
    • 9.5   Please refer to Payment Method for further information.
  • 10.   DELIVERY
    • 10.1   Unicorn Stores (HK) Ltd. shall use its reasonable endeavours to deliver the Products of acceptable quality to the delivery address (specified on the registration form filled by the Customer upon his registration with APITA UNY e-Shop services or most updated information on record) within the delivery time slots selected by the Customer upon submission of the relevant purchase order but Unicorn Stores (HK) Ltd. shall not be liable for any delays or non delivery for causes beyond its control.
    • 10.2   Place of Delivery
      • 10.2.1   The Customer must fill in details of delivery address (such as district, street, building, floor, etc.) clearly, accurately and completely. It is the responsibility of the Customer to notify Unicorn Stores (HK) Ltd. immediately of any change to the delivery address.
      • 10.2.2   Delivery service is only available to Hong Kong. Unicorn Stores (HK) Ltd. will not provide any delivery service to any territories outside Hong Kong.
      • 10.2.3   For delivery of the Products to Outlying Island (include Airport, Lamma Island, Peng Chau, Cheung Chau etc.) and private stores, Unicorn Stores (HK) Ltd. will not provide delivery service temporarily.
      • 10.2.4   For deliver of the Products to Sands Street (To Li Terrace, Ching Lin Terrace, Hee Wong Terrace, Tai Pak Terrace and Tse Land Terrace) in Hong Kong Island or any other locations which are unreachable by a truck and it requires for an entry permit and/or a closed area permit application, we will delivery the Products to the nearest location which is reachable by a truck only and the Customer needs to arrange delivery of the Products for the remaining distance by himself.
      • 10.2.5   If the Customer requires us to delivery the Products to any places where there is no lifts, it should be clearly stated on the Delivery Information. In such case, Unicorn Stores (HK) Ltd.'s delivery staff will contact the Customer for special arrangement.
    • 10.3   Date and Time of Delivery
      • 10.3.1   No delivery service on 1st and 2nd days of Chinese New Year.
      • 10.3.2   Time of delivery will be notified to the Customer by Unicorn Stores (HK) Ltd.'s delivery staff one (1) day prior to the delivery date designated by the Customer.
      • 10.3.3   If the Customer requires our notification via telephone before delivery of the Products, the Customer is required to make a remark about it on the Delivery Information. In such case, the Customer shall arrange a person to receive the Products within 1 (one) hour from our telephone notification and any delay in receiving of the Products shall be responsible by the Customer.
    • 10.4   Receiving of the Products upon Delivery
      • 10.4.1   Where the Customer requests Unicorn Stores (HK) Ltd. to put the Products outside the door of the delivery address or other place designated by the Customer, Unicorn Stores (HK) Ltd. shall not be responsible for any loss or damage to the Products which have been delivered to the designated place in accordance with the Customer's instruction.
      • 10.4.2   The Customer shall ensure that a person aged eighteen (18) or above who is authorized to receive and pay for the price of the Products is present at the specified time of delivery at the Customer's address to receive and pay for the price of the Products. If no such person is present, the delivery shall be withdrawn and attempted at another time to be agreed between Unicorn Stores (HK) Ltd. and the Customer. In such case, Unicorn Stores (HK) Ltd. reserves the right to charge the Customer an extra delivery fee.
    • 10.5   Delivery Charge
      • 10.5.1   Where the Customer makes a purchase of HK$500 (including the price of the discounted Products) or above, the Customer is entitled to a free delivery service. If the purchase amount is less than HK$500, the delivery charge of HK$80 is required for each delivery of the Products.
      • 10.5.2   There will be extra delivery charge of HK$150 to be incurred for each delivery of the Products to Tung Chung & Ma Wan and extra delivery charge of HK$350 to be incurred for each delivery of the Products to Discovery Bay.
    • 10.6   Unicorn Stores (HK) Ltd. reserves the right to decline delivery of the Products to any Customer at its sole discretion absolutely.
    • 10.7   Please refer to Delivery Details for further information.
  • 11.   SPECIAL PRODUCTS
    • 11.1   If the Customer's order of the Products includes any tobacco or alcohol products then the Customer warrants that he is eighteen (18) years of age or over and is legally entitled to purchase such products. Upon delivery of such Products, Unicorn Stores (HK) Ltd.'s delivery staff may require such person to present his identification card for verification. If no such person is present, the delivery shall be withdrawn and attempted at another time to be agreed between Unicorn Stores (HK) Ltd. and the Customer and in such case, Unicorn Stores (HK) Ltd. reserves the right to charge the Customer an extra delivery fee.
    • 11.2   The Customer shall ensure that no person or persons shall use his Login ID to purchase tobacco or alcohol products if that person or persons cannot satisfy Clauses 11.1.
  • 12.   VARIATION / CANCELLATION OF ORDER
    • 12.1   By contacting 2885-0331, the Customer may vary or cancel a purchase order without incurring any costs before Unicorn Stores (HK) Ltd. has commenced processing the relevant purchase order.
    • 12.2   Subject to the Customer's consent, Unicorn Stores (HK) Ltd. may substitute the Product for another similar product if the Product ordered by the Customer is unavailable.
    • 12.3   If there is no prior consent from the Customer for substitution, no substitution of the Product will be made.
  • 13.   RISKS AND TITLES
    • 13.1   All risks in the Products shall pass to the Customer upon delivery of the Products and in a case of the Customer requests to put the Products outside the door of the delivery address designated by the Customer, all risks in the Products shall pass to the Customer upon such time when Unicorn Stores (HK) Ltd. delivered and placed the Products in front of the door or other place designated by the Customer and in such case, Unicorn Stores (HK) Ltd. shall not be responsible for any loss or damage to the Products in accordance with Clause 10.4.1
    • 13.2   Notwithstanding the delivery and passing of risks in the Products to the Customer, the titles to the Products shall not pass to the Customer until Unicorn Stores (HK) Ltd. has received full payment of the prices of the Products.
  • 14.   EXCHNAGE OF PRODUCTS / REFUNDS OF THE PRICE
    • 14.1   We hope you will be happy with your purchase. However, where the Customer found a problem in the Product, the Customer may exchange the Product with same product by contracting APITA UNY e-Shop customer service hotline: 2885-0331 within eight (8) days from the date of delivery of the Product.
    • 14.2   The refund of the Price is available only where same product is not available for exchange with the Product as stated in Clause 14.1
    • 14.3   The Customer must register his request for exchange of the Product with APITA UNY e-Shop customer service first. We will not proceed with the Customer's request of exchange unless it is registered.
    • 14.4   The following policy will apply to exchange of the Product:-
      • 14.4.1   We can exchange the Product with the same product only if it is originally packed without any use. The Product will not be accepted for exchange, when it is used, damaged or altered (except if there is any defect due to manufacturer's fault);
      • 14.4.2   No exchange and refund for discounted/promotional products; and
      • 14.4.3   Pictures of the Products on the Site may not exactly correspond to the actual description of the Products. In such case, the written description of the Product should be relied upon by the Customer and the Customer shall not be entitled to exchange the Product on the basis that it does not exactly correspond to its picture posted on the Site.
    • 14.5   After registration of the request for exchange of the Product by the Customer, Unicorn Stores (HK) Ltd.'s staff will notify the Customer the date and relevant store for exchange or refund of the Price where applicable. Upon such notification, the Customer can come to the store in person or arrange Unicorn Stores (HK) Ltd.'s delivery staff to go to the address designated by the Customer for exchange or refund.
    • 14.6   The Customer is required to present the delivery slip and e-mail order confirmation upon time of exchange or refund.
    • 14.7   Where Unicorn Stores (HK) Ltd. refund the Price to the Customer in accordance with Clause 14.2 and the Customer made payment of the Price by cash upon delivery of the Product, the refund of the Price is made either at the store or the address designated by the Customer at the Customer's choice.
    • 14.8   Where the Customer made payment of the Price by credit card upon delivery of the Product, the following procedure must be taken:-
      • 14.8.1   the refund of the Price must be made at the store as Unicorn Stores (HK) Ltd. must verify such refund process with the relevant credit card company or bank;
      • 14.8.2   upon verification is made by Unicorn Stores (HK) Ltd., we will refund the price of the Product paid by you to the credit card account which you have used for purchase of that Products; and
      • 14.8.3   the price paid by you via credit card will only be refunded to the same credit card account and no cash refund is allowed.
  • 15.   FORCE MAJEURE
    • If the performance by Unicorn Stores (HK) Ltd. of its obligations under the Site is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, public enemy, civil war, insurrection or riot, any law, order, proclamation, regulation, demand or requirement of the Government of Hong Kong or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, power, communications or network failure, delay in transit or other causes whatsoever, whether similar to the foregoing or not) beyond the reasonable control of Unicorn Stores (HK) Ltd., Unicorn Stores (HK) Ltd. shall be excused from such performance to the extent of such prevention.
  • 16.   VARIATION OF TERMS AND CONDITIONS
    • Unicorn Stores (HK) Ltd. may update the Terms and Conditions from time to time for any reasons at its sole discretion. The Customer is reminded to review the Terms and Conditions prior to submitting any purchase order. Once a purchase order is placed, the Customer is deemed to have accepted the Terms and Conditions prevalent at the time.
  • 17.   PREVALING LANGUAGE
    • If there us any inconsistency between the Chinese and English version, the English version shall apply and prevail.
  • 18.   MISCELLANEOUS
    • 18.1   The Customer may not transfer any of his rights under the Terms and Conditions to any other person. Unicorn Stores (HK) Ltd. may transfer its rights under the Terms and Conditions to another business where it reasonably believes rights of the Customer will not be affected.
    • 18.2   If the Customer breaches any of the Terms and Conditions and Unicorn Stores (HK) Ltd. chooses to ignore this, Unicorn Stores (HK) Ltd. will still be entitled to use its rights and remedies at a later date or in any other situation where the Customer breaches the Terms and Conditions.
    • 18.3   Unicorn Stores (HK) Ltd. shall not be responsible for any breach of the Terms and Conditions caused by circumstances beyond its reasonable control.
  • 19.   APPLICABLE LAW
    • The Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region and the Customer and Unicorn Stores (HK) Ltd. agree to submit to the jurisdiction of the Hong Kong courts.
